1.1. These terms and conditions apply to all travel services and excursions offered by NextView Tours GmbH, Simmeringer Hauptstraße 397/142-143, 1110 Wien
1.2. All contracts are subject to the Austrian Package Travel Act (PRG) and the Package Travel Regulation (PRV) .
1.3. For cross-border tours (e.g. to Hungary or the Czech Republic), the traveler is responsible for complying with the entry requirements.
2.1. The presentation on the website is a non-binding offer. The contract only comes into effect upon our written booking confirmation (email).
2.2. Deposit: A deposit of 20-50% of the travel price is due upon booking (no earlier than 11 months before the end of the trip).
2.3. Final payment: The remaining 80% is due no earlier than 20 days before departure upon receipt of the travel documents.
2.4. According to the Federal Fiscal Code (BAO), all accounting documents are kept for 7 years .
3.1. Day tours: Free cancellation up to 24 hours before the start. After that, or in case of no-show, a 100% cancellation fee will apply.
3.2. Multi-day trips: Up to 30 days before departure, a fee of 20% applies; thereafter, a staggered fee of up to 90% applies (within 3 days before departure).
3.3. Extraordinary circumstances: According to § 10 PRG, the traveler may cancel free of charge if unavoidable, extraordinary circumstances (e.g. natural disasters, security risks) occur at the destination that significantly impair the execution of the trip.
4.1. Travel documents: For tours to Hungary, Slovakia, or the Czech Republic, all participants must carry a valid passport . Entry denied due to missing documents is the sole responsibility of the traveler.
4.2. Pick-up: Free hotel pick-up must be confirmed at least 24 hours in advance.
5.1. Liability for property damage not caused intentionally or by gross negligence is limited to three times the travel price .
5.2. Any defects must be reported to the tour guide immediately on site to enable immediate rectification.
6.1. Responsible person: Zija Musli, NextView Tours GmbH.
6.2. Purpose: We process your data (name, email, passport data for border crossings) exclusively for contract fulfillment and legal compliance.
6.3. SMS/MMS Communication: Promotional messages will only be sent after explicit consent (opt-in). You can unsubscribe at any time via “STOP” or “UNSUBSCRIBE” .
6.4. Your rights: You have the right to information, rectification and erasure of your data as well as the right to lodge a complaint with the Austrian Data Protection Authority.

1. Scope and Legal Foundation
1.1. These GTC apply to all travel services and excursions offered by NextView Tours GmbH. 1.2. Contracts are governed by the Austrian Package Travel Act (PRG) and the Package Travel Ordinance (PRV). 1.3. For cross-border tours, the traveler is responsible for complying with the entry requirements of the destination countries.
2. Contract Conclusion
2.1. Website presentations are an invitation to make an offer. The contract is concluded only upon receipt of a written booking confirmation from us via email. 2.2. A person booking for a group confirms they have the legal authority to represent those individuals and assumes liability for their payments.
3. Payments and Retention
3.1. Deposit: A 20% down payment is required upon booking (earliest 11 months before the scheduled end of the trip). 3.2. Final Payment: The balance is due no earlier than 20 days before departure. 3.3. Tax Retention: In accordance with the Austrian Federal Fiscal Code (BAO), transaction records will be retained for 7 years.
4. Cancellation and Withdrawal
4.1. Day Trips: Free cancellation up to 24 hours before start. 100% fee for cancellations within 24 hours or no-shows. 4.2. Multi-Day Trips: 20% fee up to 30 days before departure; tiered fees apply thereafter, up to 90% within 3 days. 4.3. Extraordinary Circumstances: Per Section 10 PRG, travelers may withdraw without fee if unavoidable and extraordinary circumstances occur at the destination (e.g., security risks, natural disasters). 4.4. Transfer: Travelers may transfer their booking to another person at least 7 days before departure.
Right to Increase: NextView Tours GmbH reserves the right to increase the travel price after the contract is concluded only if the following costs change:
Fuel/Energy: Costs for passenger transport (fuel or other power sources).
Taxes/Fees: Changes in taxes or fees (e.g., tourist taxes, landing fees, or embarkation/disembarkation fees).
Exchange Rates: Changes in exchange rates relevant to the package.
1 Thresholds and Rights:
The 8% Rule: If the price increase exceeds 8% of the total travel price, the traveler may terminate the contract without a fee and receive a full refund.
The 20-Day Rule: No price increases are permitted within 20 days prior to the start of the trip.
Notification: The traveler must be notified clearly on a durable medium (e.g., Email).
1Right to Reduction: If the contract allows for a price increase, the traveler has a legal right to a price reduction if the costs (fuel, taxes, or exchange rates) decrease before the trip starts. NextView Tours GmbH may deduct actual administrative expenses from the refund.
5. Mandatory Traveler Obligations
5.1. Identity Documents: For tours to Hungary, the Slovak Republic, and the Czech Republic, all travelers must carry a valid passport. 5.2. Coordination: Travelers must confirm their pick-up location at least 24 hours in advance.
6. Warranty and Liability
6.1. We are liable for the proper performance of all services in the contract. 6.2. Liability for non-intentional property damage is limited to three times the travel price. 6.3. Travelers must report any lack of conformity immediately on-site to allow for remediation.
7. Insolvency Protection
NextView Tours GmbH is registered in the GISA (No. 38439780). Payments are secured via insolvency insurance (e.g., Europäische Reiseversicherung). In case of insolvency, contact the liquidator within 8 weeks.
Part 3: Data Privacy (GDPR Compliance)
This section summarizes your rights and our data processing practices.
1. Processing Purposes
Personal data (names, email, passport details) is processed solely for contract performance, border crossing logistics, and legal compliance.
2. Deletion Periods (ROPA)
Booking Data: 7 years (per Austrian BAO).
Marketing/SMS: Until consent is withdrawn.
Passport Data: Deleted immediately following the completion of the cross-border tour.
3. Security
We implement Technical and Organizational Measures (TOMs) including SSL encryption, access controls, and regular backups to protect your data.
Part 4: General Provisions
Termination: We may terminate your right to use our website immediately for any breach of these terms.
Severance: If any term is found void, the remainder of these terms remains in effect.
Governing Law: These terms are governed by the laws of Vienna, Austria. Exclusive jurisdiction lies with the courts in Vienna.
